Agreement to these terms
By accessing or using petersentraining.com (the "Site"), you agree to these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. We may update these Terms from time to time; your continued use after a change means you accept the updated Terms.
About Petersen Training
The Site is operated by Petersen Training LLC, a Utah limited liability company providing project management, leadership, and construction management training, simulation, assessment, and consulting services. References to "we," "us," and "our" mean Petersen Training LLC.
How you may use the Site
We provide articles, course descriptions, instructor profiles, scheduling information, downloadable resources, and other content on the Site (the "Content") to help prospective students and clients learn about our services. You may:
- View and read the Content for personal or professional information purposes
- Download resources we make publicly available, provided you keep our copyright and attribution intact
- Share links to publicly available pages
You may not:
- Scrape, mirror, or systematically copy the Site
- Modify the Content or remove copyright, trademark, or attribution notices
- Resell, redistribute, or otherwise commercialize the Content without our written permission
- Use the Site to transmit malware, attempt to gain unauthorized access, or interfere with how the Site operates for others
Intellectual property
The Site, the Content, the Petersen Training name and logo, course materials, and all related intellectual property are owned by Petersen Training LLC or its licensors and are protected by United States and international copyright, trademark, and other laws. Any unauthorized use may violate those laws.
Third-party marks referenced on the Site (including PMP, PMI, PMI Authorized Training Partner, and similar credential or program names) belong to their respective owners and are used here for identification only. Their appearance does not imply endorsement of us by, or affiliation with, those organizations beyond what is publicly disclosed.
Your representations
By using the Site, you represent that:
- Any information you submit through our forms (name, email, company, message, and similar) is accurate and current to the best of your knowledge
- You will not misuse the Site, attempt to circumvent security, probe for vulnerabilities, or use automated tools to abuse our forms or infrastructure
- You are at least the age of majority in your jurisdiction
Third-party links and services
The Site may link to external websites operated by third parties (for example, organizations listed on our clients section, or payment pages hosted by Stripe). We provide these links as a convenience. We do not control those sites, do not endorse their content, and are not responsible for their privacy or security practices. Accessing a third-party site is at your own risk.
Disclaimers
The Site and Content are provided "as is" and "as available" without warranties of any kind, express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that defects will be corrected.
Training outcomes — including exam pass rates, certification success, and on-the-job results — depend on factors beyond our control, including your preparation, effort, and circumstances. We make no guarantees about specific outcomes.
Limitation of liability
To the maximum extent permitted by applicable law, Petersen Training LLC, its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising out of or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of those damages.
Where liability cannot be excluded under applicable law, our total liability for any claim arising out of or related to these Terms or the Site is limited to the amount you paid us, if any, in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.
Indemnification
You agree to indemnify and hold Petersen Training LLC, its members, employees, and contractors harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.
Workshops, tickets, and refunds
Public workshop tickets are sold through our payment processor, Stripe. When you purchase a ticket, your transaction is governed by Stripe's terms in addition to ours.
Custom on-site, live online, and consulting engagements are governed by the statement of work or quote we issue for that engagement, which controls in the event of a conflict with these Terms.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Site after the effective date means you accept the updated Terms. We encourage you to review this page periodically.
Governing law and venue
These Terms are governed by the laws of the State of Utah, United States of America, without regard to its conflict-of-laws principles. You and we agree that any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Utah, and you consent to the jurisdiction of those courts.
Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other right. If any provision is held unenforceable, the remaining provisions will continue in full force.
